Terms of Service

These Terms of Service ("Terms") are an agreement between you and [COMPANY_NAME] ("MakeItRap," "we," "us," or "our"). They govern your use of makeitrap.com and related services (the "Service"). By using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

1. Who can use the Service

You must be at least 18 years old and able to form a binding contract to use the Service. You may not use the Service if the law prohibits you from doing so.

2. Your account

  • You need an account to buy credits and make videos. You can sign up with email and password (we'll ask you to verify your email) or with Google.
  • Keep your login details secure. You're responsible for activity on your account. Tell us right away at [CONTACT_EMAIL] if you think someone else has used it.
  • Give us accurate information, and keep your email address up to date.
  • Some free tools may work before you sign up, using a temporary guest session.

3. The Service

  • Free tools. You can write and edit rap lyrics and get rap name ideas for free.
  • Rap videos. You upload a photo, pick a template and add a name, and we generate an AI rap video of about 15 seconds, with sound, that you can download as an MP4. Each template has its own short rap, beat, voice and style. You can't choose a voice, and videos don't use lyrics you wrote in the lyrics tool.
  • What we don't offer. The Service doesn't currently provide full-length songs, separate audio files, or voice selection.
  • Changes. We may change, add or remove features, templates or prices. If a change reduces what you already paid for, we'll treat your unused credits fairly. See section 5.
  • Availability. We try to keep the Service available, but we don't promise it will be uninterrupted or error-free. Generation can take several minutes.

4. AI-generated content

Videos are made by artificial intelligence. Results vary and may not look or sound the way you expect. A video may not look exactly like the person in the photo. Lip movement, voice, audio and visuals may contain errors. Because videos come from shared templates, videos made by different users may be similar or nearly identical, apart from the photo and name. We don't guarantee that any video will be unique, accurate, or fit for a particular purpose.

5. Credits, payments and refunds

5.1 Credits

Making a video uses credits. 1 credit = 1 video. Credits are sold in one-time packs. Current packs and prices are listed on our Pricing page. Buying credits is a one-time purchase, not a subscription, and nothing renews automatically.

5.2 Payments

Payments are processed by Stripe. When you pay, you also agree to Stripe's terms. We don't receive or store your full card number. Prices are in US dollars, and you pay any taxes that apply. You must be signed in to buy credits.

5.3 Credit rules

Credits have no cash value. They can't be transferred, sold, or exchanged for money, except where required by law. They can only be used on the Service with the account that bought them.

5.4 Credit expiry

Your credits don't expire.

5.5 Failed and blocked videos

If a video fails to generate, times out, or is blocked by our content moderation, the credit used for it is returned to your balance automatically. You won't be charged for that video. We may automatically retry a failed video once, at no extra cost.

5.6 Refunds

  • Videos that were generated successfully can't be refunded, even if you don't like the result. See section 4.

  • If you think you were charged by mistake, email [CONTACT_EMAIL] within 30 days of the charge, and we'll look into it.
  • Nothing in these Terms limits any refund rights you have under the law where you live.

5.7 Chargebacks

If you dispute a payment with your bank instead of contacting us, we may suspend your account while the dispute is open, and remove credits from that purchase.

6. Photos and other content you provide

6.1 Your responsibility

You're responsible for the photos, names, text and other content you submit ("Your Content"). You promise that:

  • you own Your Content, or you have every right and permission needed to use it on the Service;
  • you have the permission of every person shown in each photo to upload it and to have it turned into an AI video;
  • you will not upload photos of minors (anyone under 18);
  • you will not upload photos of public figures, such as celebrities, musicians, athletes, politicians or influencers, or use their names;
  • you will not upload anyone's photo without their consent;
  • Your Content doesn't break any law or anyone's rights, including privacy, publicity, image and intellectual property rights.

6.2 License you give us

You keep ownership of Your Content. You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, and change Your Content, and to send it to our service providers. This license is only for providing, securing and improving the Service. That includes sending photos to third-party AI service providers to generate your video. Our Privacy Policy explains how we handle photos, including deleting original photos after generation.

7. Acceptable use

You must not use the Service to create, upload or share content that:

  • is used for fraud, scams, or misleading people, including fake endorsements or fake statements by real people;
  • impersonates anyone, or falsely suggests that a real person said or did something;
  • is a non-consensual deepfake, meaning it shows a real person without their permission;
  • harasses, bullies, threatens, defames, or embarrasses someone. A friendly roast is fine if the person agreed to it;
  • is sexual or sexually suggestive, or involves minors in any way;
  • is hateful, or attacks people based on protected characteristics such as race, ethnicity, religion, gender, sexual orientation, disability or national origin;
  • promotes violence, self-harm, terrorism, or illegal activity;
  • infringes copyrights, trademarks, or rights of publicity or privacy, including attempts to copy existing songs, lyrics, or a real artist's voice or style;
  • is illegal in any other way.

You also must not:

  • try to get around our moderation, usage limits, or security;
  • reverse engineer, scrape, or overload the Service, or access it by automated means except through tools we provide;
  • resell the Service, or credits, without our written permission;
  • use the Service to build a competing product, or to train AI models.

8. Moderation and enforcement

  • We and our service providers may use automated systems and manual review to check content. We may block a photo, name or video, or refuse to generate it, if we believe it breaks these Terms or the law, or creates risk. If we block a generation, the credit is returned (section 5.5).
  • Moderation isn't perfect. We don't promise to catch every violation. Content that passes moderation isn't approved or endorsed by us.
  • We may remove content, suspend or close accounts, and report illegal content to the authorities. If we close your account for a serious or repeated violation, we may cancel unused credits without refund, unless the law requires otherwise.

9. Your videos

  • Ownership. As between you and us, and to the extent the law allows, you own the videos generated for you ("Your Videos"). AI-generated content may not be protected by copyright in some countries, so we can't promise you'll have exclusive rights.
  • Your use. You may download, keep, and share Your Videos, including on social platforms. You must follow these Terms and the rights of others, such as the people shown in your photos. Commercial use of Your Videos is allowed, subject to these Terms and third-party rights.
  • Labeling. Follow the rules of any platform where you post Your Videos, including rules about labeling AI-generated content. Don't present Your Videos as real footage of a real event.
  • License to us. You give us a non-exclusive, worldwide, royalty-free license to host, store, and show Your Videos to you, and to process them as needed to operate, secure and support the Service. We won't use Your Videos in our marketing without your permission.
  • Similar output. Other users may receive videos that are similar to yours (section 4). Your ownership of Your Videos doesn't give you rights over other users' similar videos, or over our templates.

10. Our content and intellectual property

The Service, including its software, design, templates, template lyrics, beats, logos and the MakeItRap name, belongs to us or our licensors. It's protected by law. We give you a limited, personal, non-exclusive, non-transferable, revocable right to use the Service under these Terms. If you send us feedback, we may use it without owing you anything.

11. No affiliation

MakeItRap is an independent service. We are not affiliated with, endorsed by, or sponsored by any artist, record label, TV show, or social media platform. Templates and styles are original and are not meant to copy any real person, song or show. Template names describe a style or trend only.

12. Copyright and takedown requests

If you believe content on the Service infringes your copyright or uses your image or likeness without permission, contact us at [CONTACT_EMAIL] (subject: "Takedown request").

  • For copyright claims under the Digital Millennium Copyright Act (DMCA), include: your signature; the copyrighted work; where the infringing material is on the Service; your contact information; a statement that you have a good-faith belief the use isn't authorized; and a statement, under penalty of perjury, that your notice is accurate and that you're the owner or authorized to act for the owner.
  • Our designated DMCA agent: [DMCA_AGENT_NAME_AND_ADDRESS].
  • For image or likeness complaints, tell us who you are, what content shows you, and where we can find it. We'll review it quickly.
  • We may remove content and close the accounts of repeat infringers.
  • If you believe we removed your content by mistake, you can send a counter-notice that meets DMCA requirements.

13. Third-party services

The Service relies on third parties, such as Stripe (payments), Google (sign-in), Resend (email), Cloudflare (hosting) and AI service providers. Their services are governed by their own terms. We aren't responsible for third-party services, sites, or platforms where you share Your Videos.

14. Disclaimers

THE SERVICE AND ALL CONTENT, INCLUDING YOUR VIDEOS, ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT ANY OUTPUT WILL BE ACCURATE, UNIQUE, OR MEET YOUR EXPECTATIONS. Some places don't allow certain warranty exclusions, so some of these may not apply to you.

15. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US $50. These limits apply whatever the legal theory, even if we were told such damages were possible. They don't limit liability that can't be limited by law.

16. Indemnity

You agree to defend, indemnify, and hold harmless us and our affiliates, officers, employees, and suppliers from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from: Your Content; your use of the Service or Your Videos; your breach of these Terms; or your violation of any law or anyone's rights, including the rights of people shown in your photos.

17. Termination

You can stop using the Service at any time. You can ask us to delete your account by emailing [CONTACT_EMAIL]. Deleting your account removes your videos and any unused credits. We may suspend or end your access at any time if you break these Terms, if the law requires it, or if we stop offering the Service. If we stop offering the Service for reasons other than your breach, we'll give reasonable notice where we can. Sections that by their nature should survive termination will survive. These include sections 4, 6.2, 9 (license to us), 10, and 14–20.

18. Governing law and disputes

These Terms are governed by the laws of [GOVERNING_LAW], without regard to conflict-of-law rules. Any dispute will be resolved in the courts located in [GOVERNING_LAW_VENUE], unless the law where you live gives you the right to bring claims in your local courts. 19. Changes to these Terms

We may update these Terms from time to time. We'll post the new version on this page and update the effective date. If the changes are significant, we'll give notice, for example by email or a notice on the Service, before they take effect. If you keep using the Service after changes take effect, you accept the new Terms.

20. General

These Terms, together with our Privacy Policy and Pricing page, are the entire agreement between you and us about the Service. If any part is found unenforceable, the rest stays in effect. If we don't enforce a right, we haven't waived it. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets. We aren't liable for delays caused by events outside our reasonable control.
